EVENT TERMS AND CONDITIONS AND DISCLAIMER
These Event Terms and Conditions (Terms) govern your registration for and attendance at events, workshops, conferences, forums or other activities hosted by Inspired Education Australia Pty Ltd (IEA) (the Event). It is your responsibility to review these Terms prior to registering for and/or attending an Event. By registering for and/or attending an Event, you agree to be bound by these Terms. We reserve the right to amend these Terms at any time.
Registration
(a) You must provide full and complete details, as required by IEA, when registering for an Event. Failure to comply all required details may delay your registration for an Event.
(b) Your registration is subject to approval by IEA. Your registration is confirmed when you receive an email notification and receipt from IEA. We will maintain a list of confirmed and paid-up delegates for each Event, and you may gain entrance to the Event by presenting identification or your email receipt. You will not receive a hard copy or electronic ticket.
(c) If a person is registering on behalf of a delegate it is the responsibility of that person to notify the delegate of these Terms.
Fees and payments
(a) The fee for IEA Events will be advertised by IEA from time to time and is subject to change without notice. IEA will use best endeavours to inform you if there is a change in the fee.
(b) Payment to attend an Event must be made prior to the commencement of the relevant Event, unless otherwise agreed with IEA in writing.
(c) In addition to the fee for your registration, you must pay GST and any booking, handling, credit card surcharge or postage fees specified.
(d) IEA reserves the right to refuse attendance to any delegates who have not paid the fee for the Event in full.
Cancellations & Refunds
(a) Cancellations and any request for a refund will only be accepted if you notify IEA in writing via email at least fourteen (14) days prior to the commencement of the Event. An administration fee may be charged for any cancellation and/or refund.
(b) Cancellations within fourteen (14) days of commence of the Event will not be accepted and no refund will be provided.
(c) No exchange, credit or refund will be given except in the case of certain cancelled or rescheduled Events (see below). For clarification, you are not entitled to a refund if:
(i) you did not enjoy the Event;
(ii) you are no longer able to attend the Event; or
(iii) you arrive late or are refused Entry for any reason.
Event Cancellation or Postponement
(a) Sometimes Events are cancelled, varied, rescheduled or postponed due to Force Majeure Events, situations which affect the speaker or other causes.
(b) If an Event is postponed:
(i) you may, at your option exercisable by notifying us in writing no later than thirty (30) days after the originally scheduled commencement date of the postponed Event, obtain a credit for the fee to put towards another of our Events that occurs within 12 months of the originally scheduled commencement date of the postponed Event; or
(ii) if you so elect, or if you fail to notify us in writing of your request for a credit within thirty (30) days after the originally scheduled date of the postponed Event, your registration will be automatically transferred to the new date for the postponed Event.
(c) If an Event is cancelled and/or a new date for the Event is not announced within sixty (60) days of the postponement/cancellation:
(i) in circumstances where the Event is cancelled due to a Force Majeure Event, you will be given a credit for the fee to put towards another of our Events that occurs within twelve (12) months of the originally scheduled date of the cancelled Event (no refunds will be issued);
(ii) in circumstances where the Event is cancelled for any reason other than a Force Majeure Event, you may, at your option exercisable by notifying us in writing no later than thirty (30) days after the originally scheduled date of the cancelled Event, obtain a refund of the fee (excluding booking, credit card and other fees). If you so elect, or if you fail to notify us in writing of your request for a refund within thirty (30) days after the originally scheduled date of the cancelled Event, you will be given a credit for the fee to put towards another of our Events that occurs within twelve (12) months of the originally scheduled date of the cancelled Event.
(d) IEA will use reasonable endeavours to delegates of a cancellation, variation, rescheduling or postponement of an Event by sending an email to the address provided to us by the delegate and/or putting a notice on our website; however the responsibility to ascertain whether an Event has been cancelled, varied, rescheduled or postponed is yours. We do not guarantee that delegates will be informed of a cancellation, variation, rescheduled or postponement before the date of the Event.
(e) Except as expressly provided in this clause or as required by law, in no circumstances will fees (or any part thereof) be refunded or credited. Any refund or credit issued will be your sole remedy for a postponement or cancellation of an Event, and we will have no further liability to you in respect of any cancellation, variation, rescheduling or postponement of an Event for any reason. Any credits issued for postponed or cancelled Events that are not used within twelve (12) months of the originally scheduled date of the postponed/cancelled Event will be forfeited.
(f) Neither party shall be liable in damages for any delay or default in performing hereunder if such delay or default is caused by a Force Majeure Event.
(g) For the purposes of these Terms, Force Majeure Event means conditions beyond a party’s control including, but not limited to acts of God, Government restrictions, quarantine, epidemic or pandemic, extreme weather, earthquake, drought, fire, flood, natural disaster, wars, insurrections and/or any other cause beyond the reasonable control of the party whose performance is affected.
Event Conduct
You are expected to behave in a professional and appropriate manner at all Events. We reserve the right to refuse entry or require you to leave if your behaviour is deemed unacceptable.
Privacy Data
You acknowledge and agree that you have had the opportunity to review the terms of IEA’s Privacy Policy located on its website.
Photography and Recording
(a) You irrevocably authorise and grant IEA the right to:
(i) record you (picture and voice) on photographs, film and/or video, for audio and visual production (the Recording);
(ii) edit the Recording into a various media production such as (not limited to) photo gallery / short film / webinar (which may include other recordings and material);
(iii) use your name and likeness, voice or other information concerning you; and
(iv) screen or place online (including on social media) the Recording.
(b) You hereby release IEA from any infringement or violation of personal and/or property rights of any sort whatsoever based upon the use of the Recording.
(c) You:
(i) acknowledge that IEA owns and shall own all rights, title and interest (including copyright) in the Recording;
(ii) You further acknowledge that IEA is not obliged to use the Recording;
(iii) warrant that I have full power to enter into this Release and that the terms of this Release do not in any way conflict with any existing commitment on my part; and
(iv) understand I will receive no monetary reward for this Recording.
(d) While under no obligation to do so, IEA will consider any reasonable request not to use or to stop using a particular Recording. Such requests should be made in writing to get@inspiredgrp.com.au at least two weeks prior to a particular event.
Disclaimer
(a) At the time of registration, IEA provided the most recent information available and the delegate and/or speaker accepts that the content and/or the delivery of the Event can change beyond the control of IEA. IEA will not take any responsibility for any errors, omissions and changes to the program or content of the event. IEA reserves the right to make changes as it deems necessary without penalty and in such situations no refunds, part refunds or alternative offers shall be made.
(b) IEA cannot control all content published or disseminated at the event. You may find other delegates’ or participants’ communications, graphics, audio files or other information inappropriate, offensive, harmful, inaccurate, dishonest or misleading and/or deceptive, however you alone are solely responsible for your interaction with other delegates and agree to act responsibly and exercise caution, common sense and safety while in attendance at the event.
(c) IEA, its directors, employees, servants, agents, partners and affiliates shall not be liable for any losses, damages, liabilities, claims or expenses whatsoever arising out of or referable to the Event.
Limitation of Liability
(a) To the extent permitted by law, IEA excludes all conditions and warranties relating to your registration for and attendance at Events.
(b) Where IEA’s liability cannot be excluded, such as in relation to Consumer Guarantees under the Australian Consumer Law or other prescribed terms under legislation, our liability for breach is limited to the fee paid by you, plus any relevant booking and delivery fees.
(c) IEA will be excused from performance under these Terms and in relation to Events to the extent such performance is affected by a Force Majeure Event.
Jurisdiction
These Terms shall be governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts in Queensland to determine any matter or dispute which arises under these Terms.
Waiver
No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under the Terms shall not constitute a waiver of such right.
Severability
If any provision of these Terms is deemed invalid or unenforceable, all or part of that provision will be severed from the Terms and will not affect the enforceability of the remaining provisions of the Terms.
Entire Agreement
These Terms constitute the entire agreement between IEA and you in relation to the Events.
